The Freebird Interiors Trade Store is intended for trade and professional customers, including sole traders and self-employed individuals. By placing an order, you confirm that the Products are being purchased for use in connection with a trade, business, craft or profession. However, where you purchase as a consumer, your statutory rights are not affected.

The below Terms and Conditions, together with any policies referenced herein describe your rights and responsibilities when you use the Services.

"Customer(s)", “User(s)”, “you” and “your(s)” means any third party that accesses the Website and is not either (i) employed by Freebird Interiors and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing Services to Freebird Interiors and accessing the Website in connection with the provision of such Services.
1.3. “Agreement”, “Terms”, “Terms of Service”, “Terms and Conditions” and “Terms and Conditions of Service” means this document, which sets out the Terms and Conditions of your use of the Freebird Interiors Trade Store Website and any of its related Products and Services (collectively, “Services”).
1.4. “Contract” means the moment a Customer's order is accepted by us on Shopify, at which a legally binding contract of sale is formed between us, the merchant (Freebird Interiors), and you, the Customer.
1.5. “Services” means any Product or Service provided by Freebird Interiors to the Customer, including this Website and the facilities, online tools and information it contains.
1.6. “Products” means any items, whether physical items or digital downloads, including merchandise, goods, materials and Services promoted and sold by us via this Trade Store Website, including, but not limited to:
1.6.1. Items we manufacture, create or produce ourselves ("Our Products");
1.6.2. Goods sourced from and supplied by external third-party suppliers or manufacturers ("Third-Party Products"); and
1.6.3. Items created or significantly modified to the customer's unique specifications or requirements ("Custom-Made Products"). Orders for Custom-Made Products cannot be cancelled, returned or refunded once production has begun.
1.7. "Website” means the website and online store you are currently visiting – https://store.freebirdinteriors.co.uk - including any and all sub-pages, but excluding any external links to other websites, outside of this domain, including social media pages.
1.8. “Content” means any text, graphics, images, audio, video, software, data compilations, page layouts, underlying code and software, and any other form of information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users.
1.9. “Feedback” means any Content that you submit, upload, post, email, or otherwise transmit to or share with us, including any ideas, suggestions, feedback, reviews, proposals, plans, images, video or other content.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country or region of residence (18 years of age for the UK), and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms "Customer(s)", “User(s)”, “you” and “your(s)” shall refer to such entity. If you do not have such authority, you should stop using the Website immediately.
2.3. To use the Services, including accessing or browsing our online stores or purchasing any of the Products or Services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
2.4. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

4. Our Products
4.1. We have made every effort to provide an accurate representation of our Products and Services in our online stores. However, please note that colours or Product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
4.2. We do not warrant that the appearance or quality of any Products or Services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
4.3. All descriptions of Products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any Product at any time and may limit the quantities of any Products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
5. Orders
5.1. When you place an order, you are making an offer to purchase. Freebird Interiors reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Freebird Interiors confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Freebird Interiors may be unable to accommodate cancellation requests after an order is accepted.
5.2. The Contract is formed when your order is accepted and we send you an Order Confirmation email.
5.3. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.
5.4. Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
5.5. You represent and warrant that your purchases are for your own business, trade or professional use and not for commercial resale or export.
6. Prices and Billing
6.1. Prices, discounts and promotions are subject to change without notice. The price charged for a Product or Service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.
6.2. Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
6.3. You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiry dates, so that we can complete your transactions and contact you as needed.
6.4. You represent and warrant that:
6.4.1. the credit or debit card information you provide is true, correct, and complete,
6.4.2. you are duly authorised to use such credit or debit card for the purchase,
6.4.3. charges incurred by you will be honoured by your credit card company or bank, and
6.4.4. you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
7. Shipping and Delivery
7.1. Standard UK Shipping is free of charge for all orders over £50. Standard Shipping is sent via Royal Mail 48hr Tracked service. Delivery estimates do not include order processing time.
7.2. Free Standard UK shipping offer applies to one UK mainland delivery address per order only. Applies automatically at checkout, no code needed.
7.3. Shipping charges apply for all orders sent outside the UK. Please see our Shipping Policy for details.
7.4. We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer Products to the carrier, title and risk of loss passes to you.

8. Discounts and Promotions
8.1. The below Terms and Conditions are applicable to all discounts and promotional offers. Please refer to individual promotional material or email for closing dates and additional terms which may be exclusive to that discount or promotion.
8.1.2. Discount code must be entered at checkout unless specifically stated otherwise, e.g. unless offer or promotion specifically states ‘discount automatically applied at checkout’.
8.1.3. Offers and promotions are valid for a limited time only - see individual promotional material or email for closing dates.
8.1.4. If a minimum spend threshold applies this excludes shipping costs (where relevant).
8.1.5. Free Standard UK Shipping offer will continue to apply to all orders over £50 unless otherwise stated.
8.1.6. Excludes sale products and gift vouchers unless stated otherwise.
8.1.7. Cannot be used in conjunction with any other offer, promotion or discount.
8.1.8. One use per customer unless otherwise stated.
8.1.9. Certain discounts may be limited to specific customers only - these discounts will be shared by Email and are exclusive to the recipient.
8.1.10. Discount Promotions apply to online orders only.
8.1.11. Discount amount cannot be exchanged for cash or credit.
8.1.12. Where a return and refund is required for any items within your qualifying order, the discount amount will be deducted from the total refund if the new total order amount will equate to less than the minimum required spend.
8.1.13. Freebird Interiors reserves the right to amend, suspend or withdraw offers and promotions at any time without notice.
8.1.14. Nothing in these terms affects your statutory rights.
9. Intellectual Property
9.1. All content on the Website, including but not limited to trademarks, brands, text, displays, images, graphics, Product reviews, video, audio, and the design, selection and arrangement thereof (“Content”), unless uploaded by Users, is the property of Freebird Interiors, our affiliates, licensors, Shopify, or other relevant third parties.
9.2. By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, foreign patent, design, database and other relevant Intellectual Property Rights and Laws.
9.3. You are granted a limited, non-exclusive, non-transferable licence to access and use the Website and Services for your own personal or internal business, non-commercial use only.
9.4. You may:
9.4.1. retrieve, display and view the Content on a device; and
9.4.2. print one copy of the Content for your personal, non-commercial use.
9.5. Except for the limited licence above, you must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any Content without the prior written permission of Freebird Interiors or the applicable rights owner.

The names, logos, Product and Service names, designs and slogans of Freebird Interiors (including Freebird Interiors Trade Store) are trademarks of Freebird Interiors or its affiliates or licensors. Shopify’s names, logos, Product and Service names, designs and slogans are trademarks of Shopify. All other trademarks appearing on the Website are the property of their respective owners. You must not use any trademark displayed on the Website without the prior written permission of the relevant owner.
10. Optional Tools
10.1. You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
10.2. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

12.1. Freebird Interiors Trade Store is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Freebird Trade, a division of Freebird Interiors Ltd. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Freebird Interiors, including any injury, damage, or loss resulting from purchased Products and Services.
12.2. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Freebird Interiors.
13. Privacy Policy
13.1. All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify’s Privacy Policy. 17. Consumer Rights
17.1. Some of our customers may purchase Products as consumers rather than businesses. To the fullest extent permitted by law, Freebird Interiors, our partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors — and Shopify and its affiliates — shall not be liable to you for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind. This includes, without limitation:
18.3.1. any business losses, including loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;
18.3.2. loss or corruption of any data, database or software;
18.3.3. replacement costs or any similar damages; and
18.3.4. any loss or damage arising from your use of, or inability to use, the Website, the Services, any Products purchased through the Services, or any Content posted, transmitted or otherwise made available via the Services, including any errors or omissions in such Content, even if advised of the possibility of such loss or damage.
19. Indemnification
